Rules and Regulations
The Association reserves the right to make and enforce such other reasonable rules and regulations as in its judgment may be deemed necessary or advisable from time to time to promote the safety, care and cleanliness of the premises and for the preservation of good order therein. It is understood and agreed between the Association and the Owner/Occupant that no assent or consent to changes in, or waiver of any part of this indenture, in spirit or letter, shall be deemed or taken as made, except the same be done in writing and endorsed hereon by the Association. Association reserves the right to alter, amend or modify these rules and regulations and also to promulgate new and additional rules and regulations at any time and in such event such altered, modified, amended or new rules and regulations shall become a part hereof and shall have the same force and effect and be binding upon the Owner/Occupant to the same extend as if incorporated herein at the time of execution of this document.
Notice of Violation Process: Any member or the Manager in behalf of the Board of Directors may report a violation of the Rules / Regulations or Covenants. The Board shall then authorize a written notification be sent. This notice may be sent via email, fax, postal service or hand delivery. The member shall receive a written “Notice of Violation” letter itemizing the violation and allowed (14) fourteen days to cure from the date of letter.
Fine Levy Process: Any member having been sent a “Notice of Violation” and having not responded to or cured the violation, or has repeated the violation within a (1) one year period shall receive a “Notice of Fine” letter, thereby imposing a daily fine to the limits established. Any violation of the Rules / Regulations or Covenants of the Association shall incur a daily fine of $25 per day to a maximum of $1,000 per incident. Fines must be paid with (15) fifteen days from the initial “Notice of Fine” letter date and shall be subject to late fee, interest charges and other remedies for collection as incurred. The payment of a fine shall not prevent the Association against the civil enforcement remedies allowed of which the prevailing party may be entitled to recovery of reasonable attorney fees and costs.
Appeal / Dispute of Fine Process: Any member may appeal/ dispute a fine by submitting a written statement within (7) seven days of the “Notice of Fine” letter. The Member must provide written notice to the Association Manager for hearing before the Covenants Committee which shall hear the matter within (30) thirty days. This process shall not hinder or otherwise waive the requirement of the Member to cure the Violation.
Architectural Review Process: As required by the Association documents, written application must be made to the Association for different events, including and not limited to, alteration or modification of structures and the landscape, which may be fences, planting trees, painting your property, adding driveways, etc. This written request must be made prior to the start of work by providing a complete narrative of when work is to start, the complete scope of work intended with a description of material specifications (size, color, type, etc) and the location of the work (typically a diagram), then an estimated completion date. Submission of this request should be done via fax, email or postal mail with delivery confirmation. A meeting will be called to order for the consideration of your request and a timely reply issued to you in writing and made part of the Association Official records. Currently, the Association Manager shall be the contact of submission.
1. All Covenants, Conditions and Restrictions of the Association shall be included as a part of the Rules and subject to the fine schedule.
2. Nuisance:
No Trash Receptacle shall be remaining on street past day of collection
No soliciting
No signs to be displayed, except one(1) for sale, for rent, or home security sign under (2)sqft
No offensive, illegal, immoral, annoying or noxious activity allowed
3. Vehicle:
No Boat Parking within view of street
No utility trailers, motorcycles or RV, except in enclosed garage
No RV extended parking (only allowed 48hr per week – no dwelling)
No Inoperable / Unlicensed vehicle parking within view of street
No commercial or vehicles with signs allowed in view of street
No overnight street parking of any vehicle
Excessive Noise
Illegal Parking on Public Roadway: Call Local Sheriff’s office
Illegal Parking on Private Property: Call any towing company, vehicle owner is responsible.
4. Landscape: (reference Association covenants)
All lawns must be Mowed/Trimmed
Grass to Concrete edging required
Shrub / Tree maintenance required
Bedding maintenance required
Debris / Trash to be collected/removed
Comments: No grass shall not exceed 6” in height and shall not grow over any concrete area (walks, drives, curbs). Areas to be maintained include easements, greenbelts and all areas owned or controlled by member. Each member shall irrigate.
5. Pets:
Number of pets cannot exceed (3) household pets
No commercial pet use or breeding allowed
Member/Guests must leash and control pet at all times
Failure to collect/remove pet waste
Noise nuisance – pet must be silenced
6. Prohibited Fixtures / Structures:
No visible antennas/satellite dish allowed within view of street or commons
No basketball goals visible beyond driveways when not in use
No clotheslines may be erected
No outdoor cooking facilities within view of street
No window air conditioning systems allowed
No carports allowed
No temporary structures allowed (tents, trailers, or any building)
7. Easement / Setbacks / Zoning / Use:
Setback violation noticed
Owner should maintain Easement Landscape
Construction/Improvement without ARC approval
Zoning Violation noticed
Property to be used for Residential Use only – No business activity
No Motorized Devices on Greenbelt (except ADA approved)
8. Work Performed without ARC approval:
No Mailbox may be replaced or relocated without ARC approval
No Fence may be installed or painted without ARC approval
No Exterior Improvement (siding, painting, lighting) without ARC approval
No Permanent Structures altered or installed without ARC approval within view of street
(Pools, Concrete, Storage Buildings, Enclosures, Play Equipment, etc)
No Construction/Improvement without ARC approval
No additional Landscape planting without ARC approval
Association Terms of Payment Policy:
All Assessment payments shall be due within thirty (30) days of invoice and any other charge levied shall be due in fifteen (15) days. Member shall assume all responsibility of any change of address notifications to Association and timely delivery of funds from member to Association by the due date (the date of payment is the date received, not date of issuance or postmark). Payments must be made by personal check, money order, certified payment, credit card or electronic transfer, no cash will be accepted. Insufficient or returned items are subject to a 5% of the face value of the check or $25 fee, whichever is higher. Credit card payments are subject to a reasonable fee payable to the processing company, paid by the member. Any payment not made by its due date shall be subject to a 5% late fee and accrue daily interest at the highest allowable legal rate, in addition to other remedies allowed by the Association.

BOD Meetings: Held at announced locations as determined by Board. Meetings are posted on front page of website and by sign at entrance of community 48hr in advance of meeting.
